Welcome to Portraits by Chaya. By accessing and using our website and services, you agree to be bound by the following terms and conditions. Please read them carefully before proceeding.

1. General Use

By accessing our site, you confirm that you are at least 18 years old or have the legal capacity to form a binding contract in your jurisdiction. You agree to use the services only for lawful purposes.

2. Photography Sessions

All session bookings are subject to availability. A deposit/session fee may be required to confirm a booking, which is a separate fee and will NOT be applied to your final balance. Cancellations or rescheduling may incur fees depending on the timing of the request. You agree to arrive on time, as tardiness may reduce your session time.

3. Payments & Fees

All payments for services are due as specified in your booking confirmation. We accept all Major Credit Cards, PayPal and Zelle, as well as options such as Affirm. Failure to make timely payments may result in cancellation or a rescheduling fee.

4. Image Usage & Copyright

Portraits by Chaya retains the copyright for all images. You are granted a license to use the images for personal, non-commercial purposes. Commercial use, reproduction, or distribution of images without written consent is strictly prohibited. We reserve the right to use any images from your session for promotional purposes unless explicitly requested otherwise in writing.

5. Product Delivery & Refunds

All products are custom-made and non-refundable. We aim to provide the highest quality and accuracy; however, if there is an issue with the product, you must notify us within 7 days of receipt.

6. Limitation of Liability

We strive to provide a high-quality service, but we are not responsible for unforeseen issues that may affect your session or the final product. Our maximum liability shall not exceed the total amount paid by you for the services rendered.

7. SMS Communications and Opt-Out

By providing your mobile number, you consent to receive SMS messages from us regarding our services and other relevant information. You can opt out at any time by replying "STOP" to a message sent to you. After you send the SMS message "STOP" to us, we will send you a confirmation SMS to acknowledge that you have been unsubscribed. After this, you will no longer receive SMS messages from us. However, we may still communicate with you — for example, to send you service-related messages necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes. If you want to join again, just sign up as you did the first time or send "START", and we will start sending SMS messages to you again.

8. Assistance and Support

9. Carriers and Messaging

Carriers are not liable for delayed or undelivered messages. We do our best to ensure timely delivery of SMS messages, but cannot guarantee that messages will be received by you in a timely manner. As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text or data plan, please contact your wireless provider.

10. Privacy and Confidentiality

11. Termination

We reserve the right to terminate or suspend your access to our services at our discretion, without notice, if we believe you have violated these terms.
